The United States Environmental Protection Agency (EPA) Spill Prevention, Control and Countermeasure (SPCC) rule applies to owners or operators of nontransportation related facilities that drill, produce, store, refine, transfer, distribute, use or consume oil or oil products and have an aggregate aboveground storage capacity of greater than 1,320 gallons that could reasonably be expected to discharge oil to navigable waters or adjoining shoreline.
SPCC Final Rule In December 2006, EPA signed a final rule amending the 2002 SPCC rule to streamline requirements for regulated facilities. This final rule provides alternative SPCC plan requirements for: facilities with aboveground storage capacity of less than 10,000 gallons; and facilities with specific types of oil-filled operating equipment. Facilities must meet reportable discharge requirements to be eligible for the alternatives. SPCC Compliance Deadline The SPCC compliance deadline has been extended to July 1, 2009, to enable existing facilities to update and implement their SPCC plans. New facilities starting operations before July 1, 2009, must also prepare and implement their SPCC plans prior to July 1, 2009. Facilities beginning operations after July 1, 2009, must prepare and implement their plans prior to beginning operations. - Prepare facility diagram, including site layout, drainage features, oil storage detail and containment
- Prepare facility-specific SPCC inspection checklist to ensure continued compliance
- Have the SPCC plan reviewed and certified by a Professional Engineer
